The contestation claim is one of the most unoriginal claims under insolvency law.
Since the introduction of the German Insolvency Act (Insolvenzordnung) many decisions have been issued in this respect; here too the focus is on analysing the enforceability of a contestation claim in conjunction with a cost/use appraisal and then enforcing the claims or the insolvency assets.
